Complex, technically demanding projects and a vast range of goods and services are delivered to customers through contractual arrangements. Formulating, negotiating and subsequently managing contracts demands a detailed understanding of both what needs to be delivered and the legal requirements. Understanding and managing risks to both technical and contractual delivery is critical to success.

Parallax Project Management Services principal consultant, Dr John Davies is a professional engineer with post graduate law, business, and systems engineering qualifications. John possesses a portfolio of skills which encompass all facets of contract management, project management, systems engineering, integration management, risk management, capital equipment procurement, and resource management. John is an experienced Capability Definition Documentation Developer and has authored numerous acquisition risk studies, integration risk studies, Operational Concept Documents and Function and Performance Specifications for the Australian Defence Force. John has provided Defence with contract better practice guides and strategic procurement advice across multiple domains.
Course Information
The course will examine:
Legal underpinnings of contracts and explains the relevant principles of the Law of Contract.
Practical contract provisions and remedies for both simple and complex procurement activities.
Focuses on establishing the customer requirements and how these are translated to unambiguous descriptions of the contractual task.
Nature of risks to the delivery of projects, with particular emphasis on the risks to delivery of acquisition and sustainment activities and how these inform project execution strategies.
Risk management and how collaborative contracts can be used to prudently manage risks.
How risks to project delivery and risks to contract delivery are identified.
The legal and commercial risks associated with probity, estopple, and variations.
How to establish contracts which enable realistic sharing of risks between customer and contractor through the use of well-structured contracts, including incentives for bearing a greater portion of the risks.
The course practises attendees in risk identification, evaluation and treatment through a series of scenario-based, role-playing exercises, with particular focus on formulation and management of contracts for complex projects.
